SUBJECT: Notice of Public Hearing for the Proposed Adoption of a Revision to the Ozone State Implementation Plan for Reasonably Available Control Technology

The Board of Directors of the Sacramento Metropolitan Air Quality Management District (District) will conduct a public hearing on October 26, 2006 at 9:30 A.M. in Room 1450 (Board of Supervisors’ Chambers), County Administration Building, 700 H Street, Sacramento, California.

The District Board will consider the adoption of a revision to the State Implementation Plan (SIP) for ozone to comply with the federal Clean Air Act requirements for Reasonably Available Control Technology (RACT).

The U.S. Environmental Protection Agency (EPA) published the final Phase 2 Rule to implement the 8-hour ozone air quality standard on November 29, 2005 (70 FR 71611). The Phase 2 Rule requires the District to submit a revision to the State Implementation Plan (SIP) that meets the Reasonably Available Control Technology (RACT) requirements for VOC and NOx in accordance with Sections 182(b)(2) and 182(f) of the federal Clean Air Act.

The District prepared a staff report that includes an analysis of District rules in place to control emissions of VOC and NOx from required source categories and major sources within the District. As a result of this analysis, Staff is proposing negative declarations for 13 source categories for which there are no applicable sources within the District:

  • Automobile Coating (Automotive Assembly Plants)
  • Dry Cleaning (Petroleum Solvent)
  • Graphic Arts (Rotogravure)
  • Large Appliance Coating
  • Magnetic Wire Coating
  • Metal Coil Coating
  • Natural Gas/Gasoline Processing
  • Paper and Fabric Coating
  • Resin Manufacturing – High Density Polyethylene, Polypropylene, and Polystyrene
  • Refineries
  • Rubber Tire Manufacturing
  • Ship Coating
  • Wood Coating (Flat Wood Paneling)

 

The staff report concludes that the District has satisfied the requirements of RACT as it pertains to the federal 8-hour ozone standard.
 
A revision to the Ozone SIP is proposed for adoption by the District Board. Included in this SIP revision is a permit for an emissions control device at major source that will make existing NOx limits for this device federally enforceable. This source already complies with the proposed emission standards. Therefore, Staff has determined that the adoption the proposed SIP revision is exempt from the California Environmental Quality Act (CEQA) under Section 15061(b)(3) of the State CEQA Guidelines because it can be seen with certainty that there is no possibility that the activity in question may have a significant adverse effect on the environment.
