SUBJECT: Notice of Public Hearing for Adoption of Rule 213, FEDERAL MAJOR MODIFICATIONS.

Notice is hereby given that the Board of Directors of the Sacramento Metropolitan Air Quality Management District will conduct a public hearing on Thursday, March 23, at 9:30 A.M. in Room 1450 (Board of Supervisors Chambers), County Administration Building, 700 H Street, Sacramento, California. The District Board will consider the adoption of new Rule 213, FEDERAL MAJOR MODIFICATIONS.

Rule 213 is being adopted to address the federal New Source Review reforms that were adopted by the US Environmental Protection Agency and California Senate Bill 288 – Protect California Air Act of 2003. The rule will exempt major modifications that are not “Federal Major Modifications” from the federal-only requirement of an alternative siting analysis.

The approval of the proposed action is exempt from CEQA since the action consists of adopting approved federal requirements and because the District has not exercised discretion by modifying federal requirements. It is considered to be ministerial in nature and thus statutorily exempt from CEQA, pursuant to state CEQA Guidelines Section 15268 – Ministerial Projects, as defined by CEQA Guidelines Section 15369.
