Clean Air Day Giveaway Rules
Official Rules
NO PURCHASE NECESSARY TO ENTER
1. Eligibility: giveaway is open to legal residents of California who live, or work within Sacramento County.
Participants must be at least 18 years old as of their date of entry in the promotion in order to qualify. Giveaway subject to federal, state, and local laws and regulations and void where prohibited by law. Employees of the Sacramento Metropolitan Air Quality Management District, the City of Sacramento, or Coalition for Clean Air (“Sponsors"), its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees"), are not eligible to participate in the Campaign. The Campaign is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
2. Agreement to Rules: By participating in the giveaway, the Participants (“You") have affirmatively reviewed, accepted, and agreed to all of the Official Rules, and agree to abide by the Sponsors' Official Rules and decisions, which are fully and unconditionally binding in all respects. The Sponsors reserves the right to refuse, withdraw, or disqualify any entry at any time at the Sponsors' sole discretion.
3. Entry Period: Promotion begins (September 9, 2024) and ends (October 2, 2024) (“Entry Period"). To be eligible for the Giveaway, entries must be received within the specified Entry Period.
4. How to Enter: Eligible Participants can enter Giveaway by completing the California Clean Air Day pledge, using the Sponsors' link and/or QR Code. When submitting the pledge, Participant must include first and last name, Zip code, and email and ensure “Share my name and email with Sac Metro Air District" is selected. A valid email is required. Incomplete entries or those that do not adhere to the Official Rules or specifications will be disqualified at the Sponsors' sole discretion.
Participating in the Giveaway involves Sponsors receiving and taking photographs, videos or motion pictures; or receiving videotapes, audiotapes, social media post, web casts, or other types of media productions that capture names, voices, and/or images (any of the foregoing types of media are called the “Materials").
By entering a submission, You grant permission to the Sponsors to use, reuse, copy, publish, display, exhibit, reproduce, and distribute the Materials in any educational or promotional materials, on Sponsors' website and social media pages, or other forms of media without notification. Participants agree to be identified by name in any material and are participating on a voluntary basis and understand they will not be compensated in any way for the Materials.
You agree to not break any law throughout the course of your participation in the Giveaway. You must comply with all applicable local, state, and federal laws, and any illegal activity, violation of law, or activity the Sponsors determines in their full discretions as unsafe or hazardous will result in disqualification.
During the Giveaway entry period, you may submit one entry, and one entry only.
5. Prizes: Only one winner will be selected for the drawing. The prize(s) shall be determined solely by the Sponsors. There shall be no cash or other prize substitution permitted. The prize is non-transferable. By accepting the prize, You grant permission for the Sponsors to use your likeness, entry, and name for purposes of advertising and trade without further compensation unless prohibited by law. Sponsors do not give tax advice and Participants should consult their own tax experts over any tax implications raised by the prize.
6. Selection and Notification of Receiving a Prize: Participants will be notified via email if they have been selected to receive a prize.
The Sponsors is not responsible for and shall have no liability for Your failure to receive notices for any reason, including security settings that may cause notifications to be marked as spam or junk.
Nor shall Sponsors be liable for Your provision of incorrect or otherwise non-functioning contact information. If selected Participants 1) fail to claim the prize within five (5) days from the time the notification was sent, 2) is found ineligible for any reason, or 3) does not pick up the prize within five (5) days of claiming any prize, the prize may be forfeited and an alternate Participant may be selected.
7. Terms & Conditions: In its sole discretion, the Sponsors reserves the right to modify, suspend, cancel, or terminate this Giveaway at any time.
8. Limitation of Liability: Your entry into the Sponsors' Giveaway constitutes Your agreement to release and hold harmless the Sponsors and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in Giveaway and/or the 1) accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Promotion administration or the processing of entries.
9. Governing Law: Any dispute that arises under or relates to this Giveaway shall be governed by California law. Venue for resolution of any dispute that arises under or relates to this Giveaway, including mediation, shall be Sacramento, California.
10. Privacy Policy: Information submitted with an entry is subject to the Privacy Policy stated on the Air District's website at https://www.airquality.org/about-us/website-policies.
11. Indemnification: By entering, You agree to release and hold harmless Sponsors and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant's participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
By Entering the Giveaway, You agree to indemnify and hold Sponsors, its officers, employees and agents harmless from and against any and all liability, loss, expense, including reasonable attorneys' fees, or claims for injury or damages relating to this Giveaway.
