Permit Exemptions

Types of Exemptions


Before requesting a permit exemption, please first review our Pe​r​m​it​​ page and check the guidance for your type of equipment or process. If your equipment or process is not clearly exempt or if you are unsure of your e​​missions, you have two options: (1) submit a formal exemption request or (2) request informal guidance.

Formal Exemption Request

​​​Prepare written details about your process and equipment.

Complete the appropriate form for your exemption type:

​​​Email the completed form and supporting documentation to permitting@airquality.org. 

​Your request will be reviewed by one of our engineering staff. Formal exemption determinations are valid for 5 years.​


​Formal Exemption Disclaimer:

Submitting a formal exemption request does not provide immunity from enforcement actions. Formal exemptions are valid only if all information provided is correct and complete and future actions remain consistent with the submitted information. Neither formal nor informal exemptions determinations provide protection against changes in laws or regulations and any new requirements. Exemptions and guidance are maintained by the District for five years.


​​​Informal Permit Exemption 


Informal guidance about whether equipment or a process is exempt from a permit can be provided for fairly simple and straightfoward requests. To make an informal request:

​​​​​

        • Call our main line at 279-207-11​​22 and ask to speak to one of our engineering staff.
        • Staff will evaluate your request and provide guidance either over the phone or via email.

Informal Guidance Disclaimer:

This is an informal communication and doe​​s not protect the receiver from enforcement action if it is later determined that a permit was actually required. If you want formal advice, the request must be made in writing, ​all information required to allow a complete analysis must be provided, and the required fee must be paid. Formal guidance can provide immunity from District enforcement actions if all information provided is correct and complete and future actions are consistent with the information provided. Neither formal or informal advice gives protection from changes to the applicable laws and regulations that may alter the prior determination. Guidance emails or letters are only effective for five years after issuance and will only be maintained by the District for the 5-year effective period.​​
